A home is often the biggest transaction of your life. Here is what a broker actually does for you, and what the law guarantees you once you hire one. No sales pitch, just what the Real Estate Brokerage Act says.

You're selling

The work that happens before the sign goes up

A listing is not just photos and a price. The law requires me to verify and disclose anything that could affect either party.

  • A price backed by real sales, not a hunch. I pull the comparables for your area and explain the gap.
  • The mandatory verifications: land register, certificate of location, taxes, co-ownership declaration, any existing inspection reports.
  • The Seller's Declarations filled out with you. I have to be there while you complete it, precisely so I can ask the right questions.
  • Listing on Centris, the brokers' province-wide database, on top of my own marketing.
  • The negotiation and the clauses, right through to the notary.
Why the Seller's Declarations matter so much: filled out properly, it is your best protection against a buyer's claim after the sale. It is the document I take most seriously.
You're buying

Being represented, or just treated fairly

This is the distinction almost nobody knows about, and it changes everything. A broker can be there without being your broker.

  • Without a buyer's brokerage contract, the broker owes you fair treatment. They can show you the property and must point out unfavourable factors, but they cannot advise you on price or negotiate it down for you.
  • With a buyer's brokerage contract, I defend your interests: price, comparables, conditions, wording of the clauses.
  • I'm with you at the inspection and I help you decide what to do with the findings.
  • I negotiate on your behalf for a better price or better conditions.
  • Your information stays confidential, including your real budget and how far you can stretch.
The question to ask on site: "Do you represent me?" If the answer is no, the person in front of you works for the seller. That is not dishonest or hidden, it is simply their role.

What the law guarantees you, whichever broker you choose

When you deal with a broker licensed by the OACIQ, you are not just buying a service. You step into a legal framework with real recourse, which does not exist in a private sale between individuals.

Indemnity fund (FICI) Financial protection in cases of fraud, dishonest dealings or misappropriation of funds.
Liability insurance (FARCIQ) Covers losses caused by a broker's fault, error or omission.
Info OACIQ An information centre you can call yourself, free of charge.
Syndic and discipline committee Investigates ethical breaches and has the power to impose sanctions.
Mandatory forms Contracts governed by the OACIQ, the same for everyone, not homemade agreements.
A licence you can check Every broker's record is public: valid licence, sanctions, suspensions.
